Minor children of U.S. Citizens, not born in the United States, may be eligible to certificates of citizenship.


Minor children of U.S. Citizens, not born in the United States, who are now residing in the United States (pursuant to lawful admission) are now eligible to immediately to obtain certificates of citizenship.

The requirements are as follows:

  • The child has at least one United States citizen parent (by birth or naturalization); AND
  • The child currently is under 18 years of age; AND
  • The child currently is residing in the United States in the legal and physical custody of the United States citizen parent, pursuant to a lawful admission for permanent residence.

Note: If the child is adopted, the child must meet all of the above requirements as well as satisfy the requirements applicable to adopted children under section 101(b)(1) of the Act.

Minor Children of United States citizens will also be immediately eligible for certificates of citizenship once they have taken an oath of allegiance, and an approval of an application for certificate of citizenship.

The following requirements are necessary:

  • The child has at least one United States citizen parent (by birth or naturalization);AND
  • The United States citizen parent has been physically present in the United States or its outlying possessions for at least 5 years, at least 2 of which were after the age of 14, or the United States citizen parent has a citizen parent who has been physically present in the United States or its outlying possessions for at least 5 years, at least 2 of which were after the age of 14;AND
  • The child currently is under 18 years of age;AND
  • The child currently is residing outside the United States in the legal and physical custody of the United States citizen parent; AND
  • The child is temporarily present in the United States pursuant to a lawful admission and is maintaining such lawful status in the United States.

Note: If the child is adopted, all of the above conditions must be fulfilled and the child must satisfy the requirements applicable to adopted children under section 101(b)(1) of the Act.
