Products Liability

A tire comes apart on the freeway, causing you to run off the road and hit a tree.  A chain saw you are using to cut off a fallen tree branch kicks back and cuts into your head.  A ladder you are using to climb onto your roof collapses causing you to fall and break your leg.  These are all accidents that may be the result of a defective product.  The tire may have been designed or manufactured improperly.  The chain saw anti kick back safety device may have failed or not been designed properly.  The ladder may have a defect that caused it to collapse.  If you are injured as a result of using a defective product, you may be entitled to compensation from the manufacturer or seller of the product.  And, in fact, in many cases the manufacturer will be responsible without you having to prove fault.  That is the concept of strict liability, in which to prevail against the manufacturer it must be proven that a product in the market is defective for its intended use, and it is not necessary to prove that the manufacturer actually knew this.  So if you are injured by a product you are using, don’t simply assume that it is all your fault.  It may be the fault of the product.  That is something that an attorney can determine, and if the product was defective, compensation for the injuries the product caused can be obtained.

If you were injured by a product which you think was faulty, contact TOREM & ASSOCIATES now.
