Head-On Collision in Selma Kills One Person

Torem & Associates

According to a news report by ABC30 News, a person died in a head-on collision in Selma last week. The crash occurred around 5:00 p.m. near Bethel and Manning. The California Highway Patrol states that a man crossed a 20-foot divider between the lanes and collided with a vehicle traveling in the opposite direction. The driver was killed in the crash. The driver of the other vehicle suffered serious injuries and was transported to the hospital for treatment. It was unknown why the driver crossed into the opposite lane at the time of the report.

Can I Recover Damages If the Cause of a Crash is Never Known?

To recover money for your medical bills, lost income, car repairs, and other damages, you must prove the key elements of a car accident claim:

  • The other driver did something to cause the collision, such as crossing the center lane;
  • You suffered injuries in the accident;
  • Those injuries resulted in damages (e. car repairs, time out of work, expenses for medical care, etc.).

Because the person in the above accident died, they may never know for sure why he suddenly crossed the center divider and collided head-on with another vehicle. An autopsy could determine whether there is a medical cause, such as a heart attack or a stroke, that could have caused the driver to lose control of the vehicle and crash into another vehicle. In some cases, the autopsy could reveal that a driver was under the influence of drugs or alcohol at the time of the crash.

Regardless, the main factor that caused the collision was the driver crossing over into the other lane. The secondary factors can help establish the “why” of the accident, but the fact was that the driver caused the crash by pulling into the lane for oncoming traffic. Once you prove this fact, you should be able to recover money for your claim.

Recovering Funds When a Driver is Killed

Some people might feel guilty about filing a claim when the other driver passed away in the crash. However, you should not be required to bear the financial burden of an accident that you did not cause. You can be compassionate and caring with regard to the death of another person while also filing an accident claim. The claim is filed against the person’s insurance coverage, not against his family. While some cases might involve the person’s estate, most of the claims are paid by the insurance company.
