Man Rescued from Vehicle in Fresno County

Torem & Associates

ABC30 News reported last week that a driver had to be rescued from his vehicle in Fresno County. Apparently, the driver lost control of his vehicle and plunged into a canal early Thursday morning between Westlawn Avenue and Belmont Avenue. The fire department and the Fresno County Sheriff’s office responded to the accident scene. The vehicle landed in approximately two feet of water.

Emergency responders were able to get the door open to rescue the driver. The driver was talking when he was pulled from the vehicle by rescuers, but the extent of the driver’s injuries was not known. The accident is under investigation to determine why the driver lost control of his vehicle and crashed into the canal.

Accidents Caused by Drivers Losing Control of Vehicles

The above accident did not involve other vehicles. However, many times when a driver loses control of the vehicle, the resulting accident involves other vehicles. Other drivers and passengers are injured because another driver lost control of his vehicle. Who is liable for the injuries in an accident like this?

In most cases, the driver who lost control of the vehicle is responsible for damages caused by the accident. While there are a few causes that are outside of the driver’s control (i.e. defective parts, road conditions, poor weather, etc.), in many cases, driver error is to blame when a driver loses control of a vehicle. Even when the weather or road conditions are a contributing factor, driver error is also a cause of the accident.

Examples of driver error that can cause the driver to lose control of the vehicle and cause an accident include:

  • Driving under the influence of drugs or alcohol
  • Fatigued or drowsy driving
  • Reckless driving and speeding
  • Following too closely for conditions
  • Distracted driving, including talking on a cell phone and texting while driving
  • Inexperienced drivers, especially inexperienced truck drivers

When a driver actions contributed to the cause of the crash, that driver can be held liable for damages. However, if the insurance company can successfully argue that the driver was not 100 percent at fault, the amount of compensation a victim may receive could be limited.

If you are injured in an accident with a driver who lost control of the vehicle, it is important that you retain the services of an experienced Fresno car accident attorney. Your attorney can investigate the cause of the accident to determine who is liable. An attorney can also file claims against multiple parties to increase the chance that you receive full compensation for all damages.
